Background
The U.S. Congress originally established the EB-5 Immigrant Investor Program as part of the Immigration & Naturalization Act of 1990 to enable foreign nationals to obtain U.S. permanent residency by making a qualified investment in a United States enterprise that leads to the direct creation of at least 10 jobs for U.S. workers. In 1992, Congress expanded the EB-5 Program by creating “regional centers,” through which multiple EB-5 investors may pool together investment funds into one enterprise and include indirect job creation toward fulfilling their immigration requirements. On March 15, 2022, the EB-5 Program was overhauled per the EB-5 Reform & Integrity Act of 2022.
Regional Center
An EB-5 regional center is a public or private economic entity in the United States that participates in promoting economic growth. Regional centers must be designated by the U.S. Citizenship & Immigration Services (USCIS) in order to participate in the EB-5 investment immigration program.

Functions of the Regional Center
Sponsorship
Select and sponsor qualified EB-5 investment projects within the regional center’s designated geographical area.
Supervision
Supervise the sponsored EB-5 projects to ensure compliance with EB-5 laws and regulations.
Reporting
Submit annual reports to USCIS about the flow of EB-5 capital, progress of each project, job creation statistics, investor data, and other related information.
